How a Real Estate Attorney Can Help with Construction Issues

Posted By Allen, Semelsberger & Kaelin LLP || 28-Dec-2017

There are a variety of reasons you may need the help of an experienced real estate attorney when buying or building a new home, and construction is a big one. As a homeowner or potential buyer, you may face a variety of construction issues, including:

  • Defects in a new home: Sometimes you can tell a new home has a major defect right away, but others may reveal themselves over the course of time, as your home holds up to varying weather, seasonal temperature changes, and daily use. Warranties for different elements of your home may vary in length, ranging from 1 to 10 years, but you may need help getting a builder to repair and replace important parts of your home, even if they are still under warranty.
  • Zoning issues: If you are building a new home, you may face difficulty building in certain areas that restrict construction of things like pools, multi-level homes, and so on. A real estate lawyer may be able to help you request a variance and move forward with your plans.
  • Easements: If you are using land that technically belongs to someone else, you may have to get an easement to use that property for a specific purpose. You may not be able to continue (or even begin) construction until you have been awarded an easement.
  • Failure by contractors to meet deadlines or perform acceptable work: At some point during or after the construction process, you may become dissatisfied with your construction company’s work. If you believe their work to be substandard and are not able to work things out directly with the company, a real estate lawyer can help you enforce the terms of your contract.

Don’t jump into a complicated construction issue without getting savvy legal counsel first. An experienced San Diego real estate attorney can help you resolve your construction issue in an efficient, timely manner. At Allen, Semelsberger & Kaelin LLP, we are committed to working with you to de-complicate the building process and allow you to continue moving forward as soon as possible.
